Scope and content

Indenture made between Joseph Mintern, described as a merchant of Passage West, County Cork, of the one part, and Father Matthew (Thomas) O'Connor, Father Anthony (John) Travers and Father Paul (William) Neary, Capuchin friars, of the other part. The deed recites an earlier lease dated 2 July 1863, under which Ellen Maria Harris Purcell of Rochestown House, County Cork, spinster, leased to Joseph Mintern lands at Rochestown, together with a dwelling house and associated rights. The property is described as containing approximately 55 acres, English statute. The recited lease was for a term of 900 years, computed from 1 May preceding the lease, at an annual rent of £23, subject to the covenants and conditions contained in the original instrument. The deed further records that Joseph Mintern had agreed with the three friars to dispose of his estate and interest in the leasehold property. In consideration of £600, acknowledged as paid to Mintern, the indenture conveys or assigns his interest in the Rochestown premises to the Capuchin friars, subject to the rent, covenants and conditions of the original lease.
