Mortgage by Thomas William Joseph Barry, 8 Queen Street, Cork, to Mary Fitzgerald, Kinneagh House, Caherciveen, County Kerry, for £700 on premises and on several plots of land in the County and City of Cork. The said plots are outlined in an attached schedule and include a dwelling house and premises at no. 6 Queen Street, Cork, in the occupation of Kate Wideman. The file includes a reconveyance (6 May 1912) by Mary Fitzgerald to Rev. Thomas Matthew O’Connor OSFC of the aforementioned mortgage on the dwelling house at no. 6 Queen Street (now known as no. 8 Queen Street). See also CA HT/2/1/1/31 for the will of above-mentioned Thomas William Joseph Barry in which he bequeaths to Rev. Matthew O’Connor OSFC his interest in the dwelling house at no. 8 Queen Street. 6 Jan. 1908. 8 Queen Street was the site of Father Mathew Hall which opened in 1907.

Particulars and conditions of sale of leasehold interest

Particulars and conditions of sale of a leasehold interest in no. 24 South Mall, Cork (for the residue of a term of 800 years). The premises were held under the above-noted lease dated 28 Feb. 1805 (see CA HT/2/1/1/28). The biddings acknowledge that Florence O’Sullivan of Kinsale, Cork, purchased the property for £165 with £41 5s paid to William Guest Lane & Co., agents for Francis Henry Walker, the vendor.

Copy assignment by Charles Henry Jermyn to trustees

Copy assignment by Charles Henry Jermyn and Aileen Dorothy Jermyn to the trustees of the Protestant Hall and Assembly Rooms Association of several leasehold premises located at no. 22 South Mall (known as the Assembly Rooms), vested in the late Charles Jermyn, father of the said Charles Henry Jermyn. Numerous annotations in pencil have been made to the copy by solicitors indicating that the trustees (also termed ‘vendors’) intend to sell their interest in the respective leases at public auction. Particulars and conditions of sale

Particulars and conditions of sale by public auction of the premises known as the Assembly Rooms, South Mall, Cork. The total rateable valuation of the property was £170. The vendors were Charles Henry Jermyn, John B. Jermyn and other trustees of the Cork Protestant Hall and Assembly Rooms Association. Reference is made to a lease of 17 Oct. 1840 from Mary Foott to Elizabeth Georgina Howard; a lease of 19 Sept. 1862 from Robert Warner and others to James Dowman; and to a lease of 1 Jan. 1846 (see CA HT/2/1/1/9). The biddings note that the property was purchased by Fr. Honorius (Francis) O’Neill OFM Cap. for £20,000. With a statutory declaration by Charles H. Jermyn re the tenancy rights of Kathleen Curtin in relation to the aforementioned property (see CA HT/2/1/1/38) 19 June 1967; and draft assignments from the vendors to the Capuchin friars. One of the drafts is annotated on the front cover: ‘Approved 28 May 1967’. Other legal documents in the file related to the said property include: Copy assignment from William James Tomkins to Sir John Scott and others of the aforementioned lease of 17 Oct. 1840 of premises on the south side of the South Mall, Cork. 22 Aug. 1905. Copy made on 2 Aug. 1967. ‘Copy extracts from the minute book of the Protestant Hall and Assembly Rooms, 1892-1967’ referring to the appointment of new trustees and to the sale of the portions of the Hall premises to the adjoining Holy Trinity Church. Copy made on 2 Aug. 1967; Requisitions on title to the Assembly Rooms property, South Mall, Cork. 9 May 1967; Copy probate and will of the aforementioned Charles Jermyn and other trustees of the Protestant Assembly Rooms, Cork. The copies were made by Gregg, Jermyn & Sons, Cork, solicitors, to facilitate the aforementioned auction. The file also includes some correspondence relating to plans for the future use of the Assembly Rooms site by the Capuchins (1974-5). See also CA HT/2/4/11.

Berard Creed OFM Cap., the FMC Trust and others to Donal Herlihy of the dwelling and premises known as the Assembly Rooms, 22 South Mall (lot 1), held under a lease dated 17 Oct. 1840 (CA/HT/2/1/1/11) and part of a car park held under a lease dated 1 Jan. 1846 (CA/HT/2/1/1/9) for the purchase money of £300,000. With copy ordnance survey map delineating the said properties. Endorsed on title page with manuscript annotation: ‘Never proceeded with, 23 Sept. 1987’.

Lease from Benjamin Whitestone, Cork, to William Clark, merchant, of a cellar, yard and linnies formerly in the possession of Paul Benson and ‘containing in front to the quay seventy-five feet and in depth at the east end thereof two hundred and twenty four feet situated on Red Abbey Island in the city of Cork’, for 800 years at the yearly rent of £70. With attached sketch map of the premises titled: ‘A map of cellars, linnies and yards near Parliament Bridge, let by Mr Benjamin Whitestone to Mr William Clark delineated in foot measurement, October 24th 1781, by Patrick [Ahern]’.

Probate of the will of Sir William Saint Lawrence Travers

Probate of the last will and testament of Sir William Saint Lawrence Travers, Rosmore, County Cork. He devises and bequeaths to his wife Elizabeth Barbara all his estate and property (real and personal) and appoints her his residuary legatee. Sir William died on 31 Aug. 1877 and his will was proved on 17 Nov. 1877. It is noted in the probate that the ‘effects sworn’ amounted to ‘under £3,000’.

Copy schedule of the estate of Robert Warner

Copy schedules and affidavits prepared for the High Court of Justice of Ireland (Probate Division) in relation to the personal estate and effects of Robert Warner, late of 71 Penrose Quay, Cork. The schedule includes property on Charlotte Quay held under lease (4 Dec. 1844) for 800 years subject to a head rent of £60; premises on Queen Street held under lease (1 Mar. 1845) for 800 years subject to a head rent of £25; and premises on Penrose Quay held under lease (27 Sept. 1875) for a residue of a term of 999 years subject to a head rent of £30 per annum during the life of Sarah Deaves.
