Holy Cross Retreat, Ardoyne, Belfast; Dispute with Bishop McAllister: Letter to Arthur Devine from the Consultor General, Thomas, Rome. He asks for copy of the agreement between Eugen Martorelli and Bishop Dorian, together with articles subscribed to by some early rectors of Ardoyne. Wants them for translation into Italian. Is aware that Sacred Congregation is loath to irritate the bishop. They are cautious because of some rescript received from Holy Office.

Informs Arthur that the bishop has aked Propaganda for a copy of the charges against him. Thomas offered to translate into English for transmission to the bishop the paper he (Thomas) had presented to Propaganda. Permission was given and also that he might make any modification he thought fit. Encloses a copy (which was not to hand at date of computerisation). Comments in the document are deliberatly mild in the hope that the bishop will give in good-naturedly.

He mentions that the provincial will have alrady shown to Arthur the General's reasons for not agreeing to Arthur's proposed translation to Australia, namely that robust health is required for that country.

Holy Cross Retreat, Ardoyne, Belfast; Dispute with Bishop McAllister:Hilary Mara: Letter to the Provincial from the Consultor General, Thoms, Rome. Has written and wired to Hilary that permission has been obtained for him to celebrate mass on board ship (on voyage to Australia?).
Bishop McAllister has got the Propaganda letter, but is on visitation at the moment and has not scrutinised it completely. He claims some of the Passionists allegations are untrue. Propaganda has told Thomas that there is no law compelling a bishop to give faculties to all religious in a community, but he cannot refuse faculties to all either. He can use his discretion as to how many faculties he gives.. The Dominicans have come up against this problem also (and that seems to have been the decison given?). Can't expect new law just for C.Ps.

Thinks ruling re faculties from Propaganda (referred to by Thoms in his letter of 14inst - see item located under serial number 1981)) is mistaken and quotes from an approved author to back him up. Is his interpretation wrong? He needs to know as it is important for him and his students. English, Scots and most of Irish bishops think what Arthur thinks. He would like a copy of the ruling which was given to the Dominicans in this metter, as he is making a file on this case.

That is not the position. Dominican's have made a submision with that conclusion to Propaganda, but that congregation doesn't want to annoy Irish bishops, so no ruling has ben given. It is said that Bishop McAllister will meet the provincial before answering Propaganda on Passionists' submission. Thomas hopes to see Cardinal (Prefect?) and read him Arthur's letter re crying need for more confessors. Even if there was a clear cut law, it could be evaded.

Anthony O'Carroll, to the Provincial, Highgate, explaining why no Passionist was at the conference of the clergy (held in the Diocese?). All were occupied and he had informed the Bishop - Bishop's reply enclosed. (NB. This reply is not attached). Anthony thinks we could not agree to the Bishop's ideas and explains why. Suggests that Provincial brings a canonist with him when he meets the Bishop. Best be prepared with facts as to what our priveileges are. If any men are presented for faculties exams, they had better be good. Anthony thinks we should act now.

Holy Cross Retreat, Ardoyne, Belfast; Dispute with Bishop McAllister: Copy of answer from Sacred Congregation of Propaganda, Rome, to Bishop McAllister. Says it
was necessary for them to consult with Passionists. This being done, they now suggest that the bishop build the church with the assistance of the rector, ownership of the church to belong to the diocese, use of it to belong to the Passionists as long as they are there; with all the details of the Constitution Romanus Pontifices being observed. The bishop to decide on the site, but congregation suggests the one near the retreat becuse of easier access, the fact that the Passioinist are donating the site and helping with the building. Msgr, Jacobini says nothig can be done. Has Arthur (Devine?) any suggestions? Should Thomas come to Ireland? The letter breaks off here. (Other pages not to hand?) .

General is away. Thanks for favourable report on Province. Glad to hear there is prospect of getting £1,000 for Wareham. Thomas doesn't know if he will go to Belfast. Consulta will decide on that after Christmas.
