Lease by Margaret Wood to Robert Warner

Lease by Margaret Wood, widow, Cork, and Rev. Joshua Browne Ryder, Castlelyons, Cork, to Robert Warner, Cork, master cooper, of a stable, coach house and concerns lately in the possession of William Cash and George Evans situated on Queen Street for 800 years at the yearly rent of £25. With attached sketch map of the demised premises delineated in hand-washed colour. The map was drawn by John Deeble, architect, 13 Cook Street, Cork, and is dated 25 Aug. 1845. With a copy memorial of said lease made by the Assistant Register of Deeds, 9 Dec. 1950.

Deed of Grant and Covenant

The deed refers to the foregoing lease dated 1 Sept. 1862 by Robert Warner to Thomas Ronayne Sarsfield and others of a piece of ground adjoining Queen Street. (See CA HT/2/1/1/13). The deed of covenant relates to an undertaking by John McNamara, Edward John Gould and Michael McNamara to maintain, ‘keep or cause to be permanently kept, built and closed up with stone and mortar two windows’ situated on the western side of the aforementioned store. The deed includes a coloured-sketch elevation of the store with the two windows marked in red ink. Scale: 15 feet to 1 inch. The elevation was drawn by Frederick A. Klein, solicitor, 21 South Mall, Cork. With a typescript copy by Guest Lane Williams & Co., solicitors, South Mall, Cork.

Particulars and conditions of sale by public auction of the premises known as the Assembly Rooms, South Mall, Cork. The total rateable valuation of the property was £170. The vendors were Charles Henry Jermyn, John B. Jermyn and other trustees of the Cork Protestant Hall and Assembly Rooms Association. Reference is made to a lease of 17 Oct. 1840 from Mary Foott to Elizabeth Georgina Howard; a lease of 19 Sept. 1862 from Robert Warner and others to James Dowman; and to a lease of 1 Jan. 1846 (see CA HT/2/1/1/9). The biddings note that the property was purchased by Fr. Honorius (Francis) O’Neill OFM Cap. for £20,000. With a statutory declaration by Charles H. Jermyn re the tenancy rights of Kathleen Curtin in relation to the aforementioned property (see CA HT/2/1/1/38) 19 June 1967; and draft assignments from the vendors to the Capuchin friars. One of the drafts is annotated on the front cover: ‘Approved 28 May 1967’. Other legal documents in the file related to the said property include: Copy assignment from William James Tomkins to Sir John Scott and others of the aforementioned lease of 17 Oct. 1840 of premises on the south side of the South Mall, Cork. 22 Aug. 1905. Copy made on 2 Aug. 1967. ‘Copy extracts from the minute book of the Protestant Hall and Assembly Rooms, 1892-1967’ referring to the appointment of new trustees and to the sale of the portions of the Hall premises to the adjoining Holy Trinity Church. Copy made on 2 Aug. 1967; Requisitions on title to the Assembly Rooms property, South Mall, Cork. 9 May 1967; Copy probate and will of the aforementioned Charles Jermyn and other trustees of the Protestant Assembly Rooms, Cork. The copies were made by Gregg, Jermyn & Sons, Cork, solicitors, to facilitate the aforementioned auction. The file also includes some correspondence relating to plans for the future use of the Assembly Rooms site by the Capuchins (1974-5). See also CA HT/2/4/11.

Copy schedule of the estate of Robert Warner

Copy schedules and affidavits prepared for the High Court of Justice of Ireland (Probate Division) in relation to the personal estate and effects of Robert Warner, late of 71 Penrose Quay, Cork. The schedule includes property on Charlotte Quay held under lease (4 Dec. 1844) for 800 years subject to a head rent of £60; premises on Queen Street held under lease (1 Mar. 1845) for 800 years subject to a head rent of £25; and premises on Penrose Quay held under lease (27 Sept. 1875) for a residue of a term of 999 years subject to a head rent of £30 per annum during the life of Sarah Deaves. Account book of subscribers for the repair of Holy Trinity Church and Friary

‘Return showing the names of persons subscribing towards the repairs of the above-named Church and Convent’ (Cork: Flynn & Company, printers, 66 George’s Street, Cork). A printed appeal on the inside front cover refers to the need for funds to execute the necessary buildings and repairs as ‘with the approach of winter, the Community find themselves literally "without a roof over their heads"’. The account book is incomplete and relates only to the Coburg Street districts. Entries are listed under names, residences and amount of weekly subscriptions. The remainder of the volume contains a history of the vicissitudes of the Irish Capuchins in the late nineteenth century. Includes short biographical notes on Fr. Louis O’Riordan OSFC (Vice-Provincial and later Commissary General), Fr. Simeon Gaudillot OSFC (a Capuchin friar from Lyons, France, who was Commissary General of the Cork and Rochestown houses) and Fr. Seraphin Van Damme OSFC (first Provincial Minister of the reconstituted Irish Capuchin Province in 1885).

Bill and certificate of costs to James Finbarre McMullen (c.1909-1957), 30 South Mall, Cork, and Fr. Martin Hyland OFM Cap., guardian, for contract work by J.A. O’Connell & Sons, sculptors, and Bartholomew Barry, builder, in ‘erecting an Altar, marble rails and floor at the shrine of St. Anne in Father Mathew Church, Cork’, and for work on the new addition to the side of the Church leading to the vestry room.

With invoices and receipts for payment of shipping costs and work on the new organ.

Church Renovation Fund Account Book

Account book for payments to a fund for the renovation of Holy Trinity Church, Cork, from Nov. 1970-Mar. 1972. Entries are listed under the headings of date, name of benefactor or payee and amount subscribed. Many of the benefactors are listed as anonymous. The first two folio pages of the volume may have been used as a cheque payments’ register (from 12 May 1970-5 Aug. 1970).

Epitome of deeds

Epitome of deeds and leases relating to properties held by the Capuchins in Cork. The epitome commences with an abstract of a lease by John Lecky to Fr. Theobald Mathew OSFC on 2 Nov. 1832 (CA HT/2/1/2/10) and concludes with a summary of an assignment by Fr. Cherubim Mazzini OSFC and others to Fr. Albert Mitchell OSFC and others of all interest and claims on premises on Charlotte Quay and on Queen Street dated 8 Mar. 1875 (see CA HT/2/1/2/13). The volume also includes transcripts and notes taken from the ‘old account book of the Cork Friary’, covering the personnel, governance and history of the Order in Ireland (specifically in Cork) from 1836 to 1859. The original volume is extant at CA HT/3/1/1.
