Particulars and conditions of sale

Particulars and conditions of sale by public auction of the premises known as the Assembly Rooms, South Mall, Cork. The total rateable valuation of the property was £170. The vendors were Charles Henry Jermyn, John B. Jermyn and other trustees of the Cork Protestant Hall and Assembly Rooms Association. Reference is made to a lease of 17 Oct. 1840 from Mary Foott to Elizabeth Georgina Howard; a lease of 19 Sept. 1862 from Robert Warner and others to James Dowman; and to a lease of 1 Jan. 1846 (see CA HT/2/1/1/9). The biddings note that the property was purchased by Fr. Honorius (Francis) O’Neill OFM Cap. for £20,000. With a statutory declaration by Charles H. Jermyn re the tenancy rights of Kathleen Curtin in relation to the aforementioned property (see CA HT/2/1/1/38) 19 June 1967; and draft assignments from the vendors to the Capuchin friars. One of the drafts is annotated on the front cover: ‘Approved 28 May 1967’. Other legal documents in the file related to the said property include: Copy assignment from William James Tomkins to Sir John Scott and others of the aforementioned lease of 17 Oct. 1840 of premises on the south side of the South Mall, Cork. 22 Aug. 1905. Copy made on 2 Aug. 1967. ‘Copy extracts from the minute book of the Protestant Hall and Assembly Rooms, 1892-1967’ referring to the appointment of new trustees and to the sale of the portions of the Hall premises to the adjoining Holy Trinity Church. Copy made on 2 Aug. 1967; Requisitions on title to the Assembly Rooms property, South Mall, Cork. 9 May 1967; Copy probate and will of the aforementioned Charles Jermyn and other trustees of the Protestant Assembly Rooms, Cork. The copies were made by Gregg, Jermyn & Sons, Cork, solicitors, to facilitate the aforementioned auction. The file also includes some correspondence relating to plans for the future use of the Assembly Rooms site by the Capuchins (1974-5). See also CA HT/2/4/11.

Berard Creed OFM Cap., the FMC Trust and others to Donal Herlihy of the dwelling and premises known as the Assembly Rooms, 22 South Mall (lot 1), held under a lease dated 17 Oct. 1840 (CA/HT/2/1/1/11) and part of a car park held under a lease dated 1 Jan. 1846 (CA/HT/2/1/1/9) for the purchase money of £300,000. With copy ordnance survey map delineating the said properties. Endorsed on title page with manuscript annotation: ‘Never proceeded with, 23 Sept. 1987’.

Particulars and conditions of sale (with tender form) of Father Mathew Hall. The spiral-bound booklet establishes the conditions of the tender for the sale of the Hall and specifies that the closing date for the submission of tenders is 21 September 2001. It also notes that the property ‘comprises of the entirety of the area contained in Lease dated the 28th of January 1890 made between Samuel Worthington of the one part and George Noble Plunkett and others on the other part’. The particulars note the some of the original leases referred to have been lost and only copy memorials will be supplied to prospective buyers. Includes tender form and copy ordnance survey map highlighting (in red ink) the Hall property.

Particulars and conditions of sale of 47-50 North King Street and certain houses on Abbey Street, to be sold by Messrs Bentley and Son, at their auction rooms, 110 Grafton Street, Dublin. The premises on North King Street have a net rental of £76 13s 10½d. The tenant for nos. 47 and 48 is Frances MacDonnell who holds the properties under a lease to Mathew Butler bearing the date of 1 May 1794. The tenant for nos. 49 and 50 is Patrick Regan who holds the premises under two leases, one to Patrick McDaniel bearing the date of 1 Jan. 1796 (See CA CS/2/2/4/2), and the other to Richard Lynch bearing the date of 1 Sept. 1829 (See CA CS/2/2/4/5). With a coloured map of the aforementioned premises surveyed by Rae and Fitzgerald, 7 Upper Ormond Quay, Dublin, 1859. Scale: 15 feet to 1 inch.

Particulars and conditions of sale of a leasehold interest in 138-140 Church Street. The premises are held under the lease from John Smith to James Willis for 99 years at the yearly rent of £50 dated 28 May 1856 (CA CS/2/2/3/2). The biddings acknowledge that John Coyle had purchased the properties from Daniel O’Brien by private treaty for the sum of £220 with £55 paid to the auctioneer as a deposit on the holdings.

Particulars and conditions of sale of a leasehold interest in no. 24 South Mall, Cork (for the residue of a term of 800 years). The premises were held under the above-noted lease dated 28 Feb. 1805 (see CA HT/2/1/1/28). The biddings acknowledge that Florence O’Sullivan of Kinsale, Cork, purchased the property for £165 with £41 5s paid to William Guest Lane & Co., agents for Francis Henry Walker, the vendor.

Particulars and conditions of sale of leasehold interest in houses on North King Street

Draft and copy particulars and conditions of sale of the leasehold interest in 47-50 North King Street, to be sold at Burke’s Great Rooms, 14 Upper Sackville Street, Dublin. The premises have a net rental profit of £64 1s 6½d. and are held under a lease for 9,000 years bearing the date of 1 July 1862 (See CA CS/2/2/4/13). The biddings note that Walter Murphy purchased the said premises from Fr. Lawrence Gallerani OSFC, Fr. Daniel Patrick. O’Reilly OSFC and Fr. James Edward Tommins OSFC for the sum of £570. With a poster (75 cm x 48 cm, OS printed on blue paper) advertising the said sale. The file also includes various legal documents drawn up to facilitate the sale including a schedule of taxes payable by the vendors on the properties; instructions for counsel regarding settling the conditions of sale; draft declaration from Fr. Daniel Patrick O’Reilly OSFC regarding title to the North King Street properties; Draft and copy assignment by Fr. Lawrence Gallerani OSFC and others to Walter and Daniel Murphy of the aforementioned premises. Nov. 1883; draft solicitor’s’ costs in preparing title and particulars of sale; correspondence of T. & C. Martin, James W. Nagle and Terence O’Reilly, solicitors, regarding efforts to trace title to the North King Street properties.
